This privacy policy provides information on how MARS Capital S.A. (“MARS”) processes personal data.

For the purposes of the applicable data protection legislation MARS is the data controller and is responsible for the confidentiality and privacy of information entrusted to it, including the personal data collected through the website (if any) and in the course of communication with website visitors, current and potential clients and counterparties.

“Personal data” is any information relating to an identified or identifiable natural person.

1. Collection of personal data.

MARS obtains personal data from visitors of the website, current and potential clients and counterparties (collectively, “Data Subjects”) in a variety of ways, including obtaining personal data directly from Data Subjects who complete online forms or communicate with MARS representatives, and indirectly, including from publicly accessible sources such as the Internet, the media, data-collection companies, debt or commercial registers or from third parties MARS may lawfully appoint.

Depending on the circumstances MARS may obtain, control and process all or some of the following types of personal data relating to the Data Subjects.

  • Identity data, including information such as full name, last name, identification numbers or similar identifiers, marital status, title, date of birth and gender, photocopies of passports, logins, usernames and passwords (encrypted).
  • Contact information, including information on home/residence/domicile address, e-mail address, communication channels, geographical location of the website visitor and telephone numbers.

We do not collect any sensitive personal data, such as identification documents that may reveal race or ethnic origin, religious beliefs or physical health, and possibly biometric data of private individuals.

In some cases, MARS website uses cookies and other technologies to automatically collect certain types of information in the course of the visit of website. The collection of this information allows us to customize your online experience, improve the performance, usability and effectiveness of the website. 2. Legal reasons of the collection and purpose of the processing of the personal data.

MARS may rely on the following lawful reasons for the collection and use of personal data:

  • Contract – MARS may process personal data due to requirements of a contract.

  • Legitimate interests – MARS may rely on legitimate interests, including interest in delivering high-quality services and marketing.

The personal data is processed for the purposes of:

-provision and development of products, services, including through the website and offline;

-marketing of services;

-evaluation of opportunities and personalizing of MARS services and information to be provided to the Data Subjects;

-promoting professional services, products and capabilities which may be of interest to the Data Subjects;

-sending of information notes and providing access specific products and events;

-administering, maintaining, developing and ensuring the security and functionality of the website;

-authenticating registered Data Subjects;

-processing requests, including responding to communications from the Data Subjects;

-complying with legal and regulatory obligations relating to sanctions, embargo assessment, countering money laundering, terrorist financing, fraud and other forms of financial crime;

It should be noted that in cases where MARS processes personal data based on a statutory or contractual requirement, the refusal by the Data Subject to provide certain data may lead to termination of services or relations with MARS.

MARS will not use automated decision-making in connection with its relations with Data Subjects.

3. Sharing of personal data with third parties

MARS reserves the right to disclose or make accessible the personal data to the following recipients based on the contractual, statutory and other requirements or authorizations, including for the performance of contracts directly or indirectly related to the Data Subject’s interaction with MARS:

  • Regulatory and governmental authorities, supervisory organizations or other third parties as required in accordance with applicable law, regulation or other binding document;
  • Parties that support the website and IT services (including providers of telecommunication systems, IT system support, archiving services, and cloud-based software services, data storage services and hosting providers, CRM systems);
  • professional advisers, including lawyers, auditors and insurers;
  • payment, securities custody and brokerage services providers;

We require third parties to respect the security of data and to treat it in accordance with the applicable law.

4. Countries where personal data is stored.

MARS stores personal data on servers located in Switzerland. MARS may transfer personal data to other permitted recipients as stated in section 3 above and such transfer may result in storage of personal data in other countries that are deemed to provide an adequate level of protection according to lists of countries published by the Federal Data Protection and Information Commissioner (FDPIC), including countries of the European Union, or otherwise exclusively to under such contractual undertakings, including standard contractual clauses approved or recognized by the FDPIC, that provide for the adequate level of data protection.

5. Data Subject’s data protection rights

The Data Subjects have the rights to

  • request access to, and receive a copy of, the personal data held by MARS;
  • request rectification or erasure of the personal data found inaccurate;
  • subject to the applicable retention periods, request that personal data be erased when its processing is no longer necessary or lawful;
  • request a restriction of processing of personal data, subject to applicable regulations;
  • object to processing or withdraw consent given in relation to the personal data;
  • receive the personal data in commonly used electronic form in cases where MARS is carrying out the automated processing of the data and the data is being processed with the consent of the Data Subject or in direct connection with the conclusion or the performance of a contract between MARS and the Data Subject;
  • file a complaint regarding processing of the personal data with the relevant data protection supervisory authority.

MARS aims to respond within 30 days from the date of receipt of privacy-related communications.

In the event the Data Subject objects to the processing of the personal data, MARS can still continue the processing if it is legally mandatory, necessary for the performance of a contract to which the Data Subject is a party or necessary for the purposes of protection of the legitimate interests of MARS or the Data Subject.

6. Personal data security

Appropriate technical and organizational security procedures are in place to protect personal data from loss, misuse, alteration or destruction. Individuals and entities who have access to the data are legally bound to maintain the confidentiality of such information.

Website visitors remain responsible for keeping user ID and password confidential.

The transmission of data via the internet is not completely secure and MARS cannot ensure or guarantee the security of your data transmitted via the website.

In the event of a personal data breach, MARS will take immediate action to restrain and remediate the breach. We will notify the relevant supervisory authority and affected individuals as soon as possible and in any circumstances within 72 hours of becoming aware of a breach when a data breach is likely to result in a high risk to the personality rights or fundamental rights and freedoms. All data breaches are documented internally, including the facts, effects, and remedial measures taken, in accordance with our accountability obligations. 7. Data retention period

MARS retains personal data for as long as the personal data is needed for the purposes for which it was collected or in line with legal and regulatory requirements or contractual arrangements.
